1. Scope

The following Terms and Conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

With regard to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contracting Party, Contract Formation, Correction Options

The purchase contract is concluded with chrispacks.com.

By listing products in the online shop, we make a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction options provided and explained in the ordering process. The contract is concluded by clicking the order button to accept the offer for the products in the shopping cart. You will immediately receive a confirmation by email after submitting the order.

The language(s) available for the conclusion of the contract: German, English

We store the contract text and send you the order data and our Terms and Conditions in text form. You can view the contract text in your customer login.

4. Subject Matter of the Contract

The respective product description is an essential part of the contract.

4.2 Product Images

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following: Due to individual screen configurations (e.g. resolution and brightness), minor deviations between the displayed and actual product colours are possible.

You also have the option of collecting your order in person from chrispacks, Karwendelstrasse 27, 83661 Lenggries, Germany, during the following business hours: by appointment.

6. Payment

6.1 Prices

The prices stated at the time of the order apply. These are total prices and include the applicable VAT.

6.2 Due Date and Default

Payment is due upon conclusion of the contract, unless a later date results from the payment terms below.

For consumers: In the event of payment default, we reserve the right to charge a fee of €1.50 per reminder from the second reminder onwards. You reserve the right to prove that a lesser damage has occurred. Further claims remain unaffected.

For entrepreneurs: In the event of payment default, we reserve the right to charge statutory default interest of nine percentage points above the base rate as well as a flat fee of €40. Further claims remain unaffected.

6.3 Payment Methods

The following payment methods are generally available in our shop:

Prepayment
If you select prepayment, we will provide our bank details in a separate email and deliver the goods upon receipt of payment.

Cash on Collection
You pay the invoice amount in cash upon collection.

Credit Card
You enter your credit card details during the ordering process. Your card is charged immediately after placing the order.

PayPal, PayPal Express
To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, log in with your credentials and confirm the payment. The transaction is processed by PayPal immediately after placing the order.

7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy. No voluntary right of withdrawal is granted to entrepreneurs.

8. Retention of Title

The product remains our property until full payment has been received.

9. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or transport insurer.

10. Warranty and Guarantees

10.1 Statutory Warranty

Unless expressly agreed otherwise below, statutory warranty law applies.

The following limitations and shortened deadlines do not apply to claims for damages caused by us, our legal representatives or agents in cases of injury to life, body or health; intentional or grossly negligent breach of duty; breach of essential contractual obligations; within the scope of a guarantee promise; or where the Product Liability Act applies.

10.2 Guarantees and Customer Service

Information on any applicable additional guarantees and their exact conditions can be found on the respective product page and on special information pages in the online shop.

11. Liability

We are always fully liable for claims based on damages caused by us, our legal representatives or agents in cases of injury to life, body or health; intentional or grossly negligent breach of duty; guarantee promises; or where the Product Liability Act applies.

In the event of a breach of essential contractual obligations through slight negligence, liability is limited to the foreseeable damage typical for the contract. Further claims for damages are excluded.

13. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered place of business.
